Cyber Crime During Covid 19

Its being noted that Cyber Crime gone up by more then 90% during Covid 19 pandemic.  Please find few steps to make sure you and your family members not be victim of Cyber Crime.

1) Next time you get a call and the caller asks you to upgrade your SIM to 4G e-SIM, just hang up the phone and report the number on Cybercrime Reporting Portal: http://cybercrime.gov.in

2) Always make two separate e-mail accounts. One for communicating with people you trust and for your financial transactions. Use separate e-mail account for registering on social networking sites. This will protect your primary account from online stalkers.

3) Some cyber criminals compromise victim’s social media account; and contact friends or family members seeking financial assistance on urgent basis on pretext of emergent situation> Please verify the authenticity of emergency from concerned relative/friend by calling them before making any payment.

4) Beware of e-commerce websites and advertisements selling items at highly discounted prices. If website seems doubtful, avoid any transaction.

5) Avoid receiving normal/whatsapp calls from numbers starting with +92. These may be used for soliciting sensitive information.

6) Do not respond to any message assuring credit of money into your bank account with request to share personal details. It may be an attempt to defraud you.

7) Be careful while posting your personal details on customer care handles of social media platforms. Personal information may be misused by unscrupulous person for conducting financial frauds.

8) Beware of Job frauds conducted by using names of reputed companies/organisations. Fraudsters offer job or pre-training and demand money for registration charges.

9) Sharing your sensitive personal details such as address, phone number, Aadhaar number, photo, date of birth etc. on social media makes it easier for a stalker to misuse such details to harass you. It is advisable not to post such details on social media.

10) Always Change Password at regular interval as a precautionary Measure.

A daughter remains a loving daughter throughout life : Justice Arun Mishra

The Supreme Court, on Tuesday said that daughters will have right over parental property even if the coparcener had died prior to the date when Hindu Succession (Amendment) Act, 2005 came into force.

Important judgment was pronounced by a three-judge bench of the apex court headed by Justice Arun Mishra.

The judgment implies that daughters will have the right over parental property even if the coparcener had died before the Hindu Succession (Amendment) Act, 2005 came into effect.

“Daughters must be given equal rights as sons, Daughter remains a loving daughter throughout life. The daughter shall remain a coparcener throughout life, irrespective of whether her father is alive or not,” Justice Arun Mishra was quoted as saying by Livelaw.

The bench held that the said amendment is applicable to ‘living daughters of living coparceners as on 9 September 2005’, irrespective of the date when the daughters are born.

RBI revises the instructions on opening of current accounts by banks

The Reserve Bank of India (RBI) on August 6, 2020 has revised the instructions for the opening of current accounts. The instructions for this purpose were earlier issued on July 02, 2015 vide Circular no. DBR.Leg.BC.25./09.07.005/2015-16. The instructions have been further reviewed and revised.

Following are the revised instructions: 

• Banks should not open accounts for all the customers who have availed the credit facilities in the form of cash credit (CC) or overdraft (OD).

• In case the bank’s exposure to the borrower is less than 10 percent of the exposure of the borrowing system, the credit to the account of the borrower can only happen, if the bank has 10 percent or more exposure to the banking system to that borrower.

• Where a bank has a share of 10 per cent or more in the total exposure of the banking system to the borrower, it can provide CC/OD facility as hitherto.

• Customers who have not taken the facility of CC/OD from any banks, can open their current accounts according to these guidelines:

1. Banks must put an escrow mechanism in cases where the exposure of the banking system is more than 50 crores. Only the escrow managing banks can open the current accounts of such borrowers.

2. Borrowers who have banking system of more than 5 crores, but less than 50 crores can open the current accounts without any restrictions.

3. Where the banking exposure is less than 5 crores, the banks can open current accounts, but they must obtain an undertaking from the consumers.

4. Banks are free to open the current accounts of the consumers, but they have to go through proper due diligence according to the guidelines framed by the Board.

• Banks should monitor all such activities regularly on a quarterly basis, to ensure the compliance.
